Abstract:

В статье рассмотрен вопрос о том, можно ли считать гражданских лиц, занимающихся распространением пропаганды, непосредственными участниками военных действий. Основное внимание уделяется пробелам, возникающим в связи с отсутствием положений международного права, регулирующих использование пропаганды во время вооружённых конфликтов. Утверждается, что классификация пропаганды имеет важное значение, учитывая растущее использование вредоносной цифровой информации. Пример украинских кампаний стратегической коммуникации иллюстрирует скользкую дорожку, создаваемую легкодоступными платформами социальных сетей, и опасность, исходящую от гражданских лиц, ведущих эти так называемые «кампании стратегической коммуникации». В исследовании рассмотрено применение принципа различия и понятия непосредственного участия к украинским гражданским лицам. В статье показано, что при анализе применимой правовой базы, касающейся распространения пропаганды, существует множество серых зон. Исследование заканчивается выводом, что гражданские лица, распространяющие пропаганду, не подпадают под определение непосредственных участников военных действий, поскольку не выполняется тройной тест Международного комитета Красного креста.
